to cover
how to file and serve your small claims
lawsuit
in california so the first step before
you even
decide to file and serve your lawsuit is
you're going to want to
demand payment what does that mean
that means you want to ask the other
party before you sue
to either pay you back or return your
property for example if you're suing
someone
over a car they took you want to ask
them hey can you return my car
before you even decide to sue in small
claims as the lawsuit
will ask you if you've done this
second where to sue where
are you going to file this small claims
lawsuit
first you want to narrow this down by
county
and then some counties have multiple
courts within the county
you could always sue in the county
where the person you are suing where
they live
or if it's a business where they have a
place of business
and then the court it's a little bit
more tricky
i will go ahead and put link in the
description
for those counties that do have multiple
courts within them like l.a county i'll
include a link
in the description for how to narrow
down which court in la county
who to sue it may seem obvious
sometimes it's not one of the most
common mistakes
we see here is if you're suing
for a security deposit you want to make
sure you're suing
the person who is holding on to your
security deposit
this is usually your landlord and not
your
property manager for this you definitely
want to sue whoever
is responsible for what happened to you
it can be a little bit hard to pinpoint
when in doubt
include several people and at the
hearing
the judge can determine who is at fault
for what happened to you
so up next is prepare and file the
sc-100
the sc-100 is the main small claims
lawsuit you are going to prepare if
you have additional people you're suing
there are additional forms
if you are a business there are
additional forms you have to complete

so i will put the link in the
description each county
does have a different method of how to
file the lawsuit
so it's very important you do follow
their procedures or your lawsuit will be
rejected when you go on file
once the lawsuit is filed so once the
court has processed your lawsuit once
the court has
given you a hearing date and a case
number you
are going to serve the other party and
by you
does it really mean you are going to
hand over the paperwork to the other
party
rather someone other than you is going
to
go up to the other party and deliver the
paperwork to them
there are a lot of rules around serving
uh we can talk at links about this
we'll go ahead and link another video in
the description for this
but this is the act of delivering the
paperwork to the person or business you
have sued
to let them know that they have been
sued
once they have been served the person
who did that act of serving
is going to file and prepare the
proof of service which is basically a
document that tells the court
i have sued the person in the lawsuit
and this is how i served them i think i
might have said sued
this is how i served the other party
and here is the proof here's my
signature they're certifying to the
court that they have done this
you're going to prepare for the small
claims hearing
you want to make sure you have your
evidence ready to go
you want to make sure you have any
contracts pictures
text messages anything that is relevant
for the judge
to decide your case you want to make
sure you include it
